Legal Terms

Last updated: November 1st, 2025

These terms apply to the use of this website and to any services purchased from Toothy Grin Marketing LLC (“we,” “us,” or “our”). By using this site or working with us, you agree to these terms.

2. Use of This Website

You agree to use this website for lawful purposes only. You may not attempt to copy, reverse engineer, interfere with, or misuse any part of the site, its systems, or its content.

We reserve the right to update, change, or remove content at any time.

3. Services and Projects

All services, proposals, and deliverables are described in writing before work begins (for example, in a proposal, estimate, or statement of work).

Each project may have its own timeline, scope, deliverables, payment terms, and expectations, which will override anything in this general legal page.

4. Payments and Billing

Payment terms will be specified in the proposal or agreement for your specific project. Examples may include:

  • Full payment upfront
  • Deposit + milestone/final payment
  • Recurring billing for ongoing services

Invoices must be paid on time to avoid delays in work. We reserve the right to pause services if payment is late.

All payments are processed securely through third-party processors such as Stripe or Payments AI via ClickFunnels. We do not store credit card numbers on our own servers.

5. Refund Policy

Because our work is service-based and often customized, refunds are handled case-by-case.

In general:

  • Work that has already been completed is non-refundable.
  • If a project is cancelled before any work begins, a refund may be issued.
  • In cases where a refund is agreed upon, funds will be returned using the original payment method.

If a specific project includes a guarantee or refund promise, it will be stated in the proposal or statement of work, and that language will override this general policy.

6. No Guaranteed Results

We do not promise or guarantee specific business outcomes, increased revenue, or performance results.

We will always act in good faith and deliver work as agreed, but business outcomes depend on many factors outside of our control, including implementation, product, audience, budget, timing, and market conditions.

Any guarantees or performance commitments must be explicitly written into a project agreement before work begins.

7. Client Responsibilities

To complete work on schedule, the client agrees to:

  • Provide access, information, assets, or approvals in a timely manner
  • Respond to requests needed to move the project forward
  • Supply accurate information and materials

Delays in client response may delay project timelines. We are not responsible for delays caused by missing information or lack of communication.

8. Limitation of Liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, or consequential damages, including lost profits, revenue, or data.

Our total liability for any claim related to services is limited to the amount paid for those services.

9. Digital Delivery / No Shipping

We do not ship physical products. All services, deliverables, and communications are delivered digitally (online, email, shared documents, or virtual meetings).

10. Support and Contact

If you need help with billing, project questions, or account-related issues, contact us at: support@toothygrinmarketing.com

Emails are typically answered within one business day.

11. Changes to These Terms

We may update these terms at any time. If changes are made, the “Last updated” date at the top of this page will be revised. Continued use of this site or our services means you accept the updated terms.

12. Governing Law

These terms are governed by the laws of the State of Wyoming, United States. Any disputes will be handled in a Wyoming-based court unless both parties agree otherwise.
